Executive Law currently authorizes local governments to enact or adopt local laws imposing MRLS for construction that differ from those imposed by the Uniform Code. Though within thirty days of enactment or adoption of such law, the local government must petition the Code Council for a determination of whether the local law is in fact more stringent than the Uniform Code.

Under the current law, while the Code Council is considering such a petition, any such law may remain in full force and effect. NYSBA is proposing legislation that would reverse this process and require the Code Council to approve any MRLS imposed by local law before the standard may become effective.
