In many communities, community benefits agreements are imposed arbitrarily upon a developer for actions that are far from the site of the development and are not in relation to any mitigation of issues raised under SEQRA. In many cases the amount of such benefits is arbitrarily created by municipal officials and have no relation to the size or financial viability of the project.

NYSBA supports legislation (S.3415 – Zeldin / A.3089 – Lavine) that will create standards which any benefits must meet to ensure that such benefits are related both to the size and financial viability of the project.
